Your purchases from this site constitute an agreement to be bound by these terms, and the terms of any limited warranty accompanying the product. You agree that we New Kensington Trading Inc. may make changes to the products and pricing (point system of pricing) at any notice, and further agree that this CNTL rewards website can revise these Terms and Conditions at any time without notice by updating this posting. Your continued use after these possible modifications constitutes your acceptance of such revised Terms and Conditions. Products purchased from this website are strictly for personal use and cannot be resold to others.

All purchases must be made by employees in their own names and never on behalf of another employee or using another person’s points, nor can these points be bartered or traded amongst drivers. Products may only be purchased only for personal use, for friends and family, or as gifts. Products may not be purchased for resale or as part of a commercial enterprise.

You agree that you will be responsible for any and all information put forward, and acts or omissions that occur, through the use of your password. ORDERING

You can make an immediate purchase by buying the “Buy it Now” button, or you can add the product(s) you want to your cart by clicking the “Add to Cart” button. Follow the directions on the “Buy it Now” button, please make sure all of the information is correct as those product decisions will be final. There should be ample information in order to make an informed buying decision. After completing checkout, you will receive a confirmation email confirming the order. When the order is shipped, you will receive an email with tracking number.

STOCK

We will try our best to keep everything in stock as displayed. However, there may be times where an item is out of stock and we will do our best to inform you right away.

PURCHASE LIMITATIONS AND RESTRICTIONS

You may use up as many points as you have in your wallet, the system will not allow you to purchase more than what you have.

ISSUES WITH ORDERING ON THE SITE

If you have any issues working with the site, in the ordering and delivery of your goods, please email us with those details and we will do our best to get back to you promptly.

ORDER STATUS AND SHIPPING

You will receive a confirmation email upon ordering and we will do our best to ship the order out within 7 days, you will receive tracking accordingly.

RETURNS

- Garments: please be certain you look at the sizing chart and other details before making a selection; if there is an issue with the garment beyond this, please email us and we will consider a return and replacement piece.
- Hard goods: many of the hard goods come with manufacturers warranty. It is the responsibility of the purchaser to register the product just as in a retail purchase and abide by the tenets of the manufacturer’s warranty.

If the shipment arrives damaged, please inform us immediately, with the order number and what is wrong with the shipment, we will do our best to get back to you promptly. If the return has been accepted, we will issue you a Return Authorization number, and shipping labels accordingly.

LEGAL

Limitation of Liability – YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, New Kensington Trading Inc, CNTL AND ITS AFFILIATES, INCLUDING SUPPLIERS SHALL NOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY (WHETHER CONTRACT, TORT INCLUDING NEGLIGENCE OR OTHERWISE) FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES THAT MAY BE INCURRED BY YOU IN CONNECTION WITH THE GOODS AND/OR SERVICE OR THESE TERMS, INCLUDING ANY LOSS OF DATA, WHETHER OR NOT a NKT, CNTL PARTY OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING. YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PARTIES’ TOTAL LIABILITY IN CONNECTION WITH THE GOODS OR THESE TERMS WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO THESE PARTIES UNDER THESE TERMS.

Governing Law – This Agreement shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflicts of laws rules. Any action arising out of a dispute between the parties shall be brought in the Province of Ontario and the parties consent to and submit to the jurisdiction of the federal and provincial courts located in the Province of Ontario and waive the right to change venue.
